Most people have an idea as to how they would like their estate to be distributed after their death. You will need to take steps to ensure that you consider all your dependants and their needs, your assets and liabilities and how it will all be distributed following your death.
Legal provisions of the Succession Act 2006 can allow wills to be contested in Court. CHM Legal can give you practical, accurate, easy to understand advice to assist you in to making an effective will. If you do not have a Will, you should consider contacting us now and making an appointment.
CHM Legal will also work closely with Executors of deceased estates in assisting them with administration of estates.
Family Provision Claims
Pursuant to the Succession Act 2006 certain types of people may contest a deceased's Will if they are an "eligible person" under the Act. A family provision claim can be made by an eligible person under the Act, making a claim to the Supreme Court advising that the deceased's Will has failed to make adequate provision for them.
CHM Legal can assist you in lodging proceedings should you believe you have been left out of a will or alternatively in acting for executors in defending the will from a family provision claim. For further information regarding family provision matters, contact our office.
